Macron approves assisted dying law; strict conditions spark widespread debate in France

Paris, France – French President Emmanuel Macron signed into law the Medical Assistance in Dying (MAD) bill, a significant shift in how France addresses the issue of terminally ill patients. This comes after years of intense political and public debate surrounding the limits of the right to choose the end of life. The law establishes a clear legal framework for accessing this option, but it does not grant it openly to all patients. It requires meeting a set of medical and legal criteria and ensuring that the decision is made by the patient of their own free and informed will.

To benefit from this law, the person must be an adult and a French citizen or a permanent resident of the country. Furthermore, they must be suffering from a serious and incurable illness that has reached an advanced or terminal stage and causes severe suffering that cannot be adequately alleviated by available treatments. The patient must also be of sound mind and able to understand the nature and consequences of the decision. In addition, they must be able to clearly express their wishes without coercion or pressure from others.

Simply submitting an application is not enough; the patient undergoes a thorough medical evaluation to ensure they meet the criteria. Their case is also reviewed by multiple specialists before a final decision is made. The system initially grants the patient the option to self-administer the substance intended for ending their life. However, a member of the medical staff can intervene in cases where the patient is physically unable to carry out the procedure.

The law also includes mechanisms to ensure the patient’s continued consent, including reaffirming their agreement before the procedure, in an effort to reduce the likelihood of a hasty decision or one made under temporary circumstances. The law’s passage has sparked considerable division within French society. Supporters argue that it grants patients facing unbearable suffering the right to determine their own fate. Opponents, however, fear that expanding the scope of assisted dying could disproportionately affect the most vulnerable patients or open the door to family and social pressures.

The French move comes at a time of growing European debate on end-of-life issues, with significant differences between countries in their legal approaches to medically assisted dying or euthanasia. Supporters of the legislation assert that its primary goal is to provide a structured legal framework that protects both patients and doctors in cases that meet the criteria. Opponents, however, emphasize the need to develop palliative care and provide psychological and social support to patients before resorting to any option related to ending life. With Macron’s signature, France enters a new phase in this highly sensitive matter. There is now much anticipation regarding the practical implementation of the law and how medical and judicial institutions will handle cases that seek to benefit from its provisions.
