Abu Dhabi, UAE – Israeli media reports indicate that Israel intends to try those accused of involvement in the October 7, 2023 attack before a special military court.
This move, described as “exceptional” from a legal standpoint, coincides with the ongoing military operations in the Gaza Strip.
New judicial framework
According to Israeli media reports, State Attorney Gali Baharov-Meara clarified
that military prosecutors, not civilians, will be handling the indictments.
This is based on a bill that passed its first reading in the Knesset, paving the way
for a special legal track to deal with cases related to the attack.
This approach comes amid legal and security complexities surrounding the case.
Israeli authorities are seeking to establish a legal mechanism that would allow
for swift and comprehensive trials for those arrested during military operations.
Conflicting figures regarding the attack and the war
According to the Israeli account, more than 3,000 members of Hamas and other armed factions,
along with Palestinian civilians, participated in the attack launched from the Gaza Strip.
The attack resulted in the deaths of more than 1,200 people and the abduction of over 250.
In contrast, a Hamas-affiliated health authority in Gaza reported
that the number of Palestinian deaths since the start of the war has exceeded 72,000.
This comes amidst widespread destruction in the Gaza Strip and a worsening humanitarian crisis.
Expected indictments
The Israeli newspaper Yedioth Ahronoth reported that preparations are underway to indict more than 300 members of Hamas’s elite unit.
This comes as part of anticipated legal proceedings before a special military court.
